These Terms & Conditions ("Terms") are entered into between you and Stkvel ("Stkvel", "we", "us", or "our"), the legal entity and seller operating the Stkvel platform. Stkvel is a web application for running stokvel and savings groups. By creating an account or continuing to use Stkvel, you agree to be bound by these Terms. If you are using Stkvel on behalf of an organisation, you confirm that you have the authority to bind that organisation to these Terms.

1. The service

Stkvel provides tools to create savings groups, track contributions, schedule payouts, manage budgets, and communicate with members. The features available to you depend on the plan you select and may change from time to time. We do not hold, transfer, or custody member funds — Stkvel is a record-keeping and coordination tool only.

2. Your account

You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you are an individual, you must be of legal age in your jurisdiction to enter into these Terms.

3. Acceptable use

You agree not to:

• use Stkvel for any unlawful, fraudulent, or deceptive purpose;
• send spam or otherwise abuse the notification and messaging features;
• infringe any intellectual property, privacy, or other rights of Stkvel, other users, or third parties;
• probe, scan, or test the vulnerability of the service, introduce malware, or interfere with its integrity or performance;
• scrape, harvest, or automate access to the service without our written permission.

4. Intellectual property

Stkvel and all associated software, documentation, and branding are and remain our property or that of our licensors. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use Stkvel within the plan you have selected. You must not reverse engineer, resell, redistribute, or attempt to circumvent any technical limitations of the service.

5. Your content

You retain ownership of the content you submit to Stkvel (group names, member information, contribution records, messages, etc.). You grant us a limited licence to host, process, and display that content solely as needed to operate and improve the service on your behalf.

6. Payments, subscriptions, and refunds

Paid plans are billed on a recurring basis for the term you select (for example monthly or yearly). Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing frequency, taxes, and refund handling are governed by Paddle's Buyer Terms. Our own refund policy is available at /refund.

7. Service availability

We work to keep Stkvel available and reliable, but we do not guarantee that the service will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Suspension and termination

We may suspend or terminate your access to Stkvel if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or otherwise seriously or repeatedly violate our policies. You may stop using the service at any time by cancelling your subscription from your account. On termination, your right to use the service ends and we may delete your data after a reasonable retention period as described in our Privacy Notice.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the service or these Terms is limited to the total fees you paid to us in the twelve months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot lawfully be excluded, such as for fraud, death, or personal injury caused by our negligence.

10. Indemnity

You will indemnify and hold Stkvel harmless from claims, losses, and expenses arising out of your content, your unlawful use of the service, or your breach of these Terms.

11. Changes to the service or these Terms

We may modify or discontinue features of Stkvel and may update these Terms from time to time. If we make material changes we will provide reasonable notice, for example by email or in-app notification. Your continued use of the service after such changes constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Stkvel is established, without regard to conflict-of-laws principles. Any disputes will be resolved by the competent courts of that jurisdiction, unless applicable law requires otherwise.
